In the name of god amen the sixteenthe day of Marche in the yere of oure Lord god a thowsand five hundred and eightie one and in the three and twentith yere of the raigne of oure soveraigne Ladye Quene Elizabethe I John Payne of Westhothley in the countie of Sussex th’elder beinge sicke in bodie but of good and perfect memorye (thanked be god) Do make and ordeyne this my laste will and testamente in manner and forme folowinge. First I bequeath my soul unto the mercifull handes and protection of Almightie god beseeching hym to save and recyve the same to his mercy which his sonne and my Savioure Jesus Christ hath so deerlie and lovinglie boughte and redemed with the price of his most pretious blood. Item I will my bodye to be buried in the churchyarde of Westhothley in suche place tyme and order as to the executors and overseers of this my last will shall seeme meete and convenient. Item I give to Richard Payne my sonne twentie poundes to be payed unto hym within one yere next after my decease and one twelvemonthing heffer bullocke being of colour browne. Item I give to Edward Payne my sonne eighteen poundes to be payed unto hym when he shall accomplishe the age of one and twentie yeres. Item I give and bequeathe to George my sonne xviij li (£18) to be paid unto hym when he shall accomplishe the age of one and twentie yeres. Item I give and bequeathe to Joane Payne my daughter fifteen poundes to be payed unto her when she shall accomplishe the age of one and twenty yeres or els at the daye of her marriage (yf she shall happen to marrye before) And yf it shall happen my saied sonnes or daughter Edward, George or Johane or any of them to decease before theire saied severall ages and tyme appoynted for the paymente of theire severall stockes and money payable unto them then my will is that his or her part so deceased shall remayne and be payed to the survivors or the survivor of them the saied Edward, George and Johane or either of them to be equallie shifted betwene them at suche tyme as is before appoynted. Item I will and bequeathe to Margaret Browne my servante one two yereinge redd heffer bullocke. Item I will to the poore mens boxe of Westhothley twelve pence. Item I do ordeyne Johane my wife and John my sonne joynte executors of this my last will. And my will is that they paye and dischardge my debtes legarceys and funerall charges. And I do ordeyne and appoynte Thomas Payne and Edward Payne my bretheren and Thomas Combar of Westhothley myne overseers of this my laste will hopinge as my truste is in them that they will see this my will performed accordinge to my meaninge. As touching the disposicion of my landes I do give all my landes and tenements with th’appurtances set lying and beynge in Westhothley in the Countie of Sussex called and knowen by the name of the breches or Stonelande or by any other name whatsoever unto John Payne my sonne and to his heires for ever and allso the tithes of the sayed lande and allso the profitt of the mill which I have from my brother Thomas Payne of Stone. Item I will and give unto Thomas Payne my sonne all my landes in Horlie in the County of Surrey with all th’appurtances whatsoever with the condition that my sayd sonne shall suffer myne overseers to have the lettinge and settinge of the sayed landes ymediatlye after my decease until they have levyed and reared thirtie poundes the use and performance of this my laste will and after the sayed twentie poundes levyied the sayed landes to remayne to my sayed sonne Thomas and to his heires for ever. Item I give and bequeathe to Henry Payne my sonne one yerelie rent of three pondes six shillinges eight pence due unto me and yssuinge oute of the landes and house of Stone Place in Erdingley with condition that my sayed overseers shall receive the same rent ymediatlye after my decease to the use and perfomance of this my laste will untill twentie fyve poundes be fully levyed and recyved. And after the sayed fyve and twentie poundes levyed and receyved I will that the sayed rent remayne to my sayed sonne Henry and to his heires for ever. And yf it shall happen the saied Henry to dye before he shall accomplishe the age of one and twentie yeres then my will is that the sayed rente shall remayne to Edward Payne and to his heires with condition that the sayed Edward shall paye tenne poundes unto his brother George within one yere next after the decease of the sayed Henry Payne. And my will is that my sayed overseers put in sufficient bonds and assurance to myne executors for the paying over of the sayed money which they shall receyve to the use of my sayed children according to the true meaninge and intente of this my last will. Witnesses of this my laste will John Culpepper parson of Erdingley, John Newnam and Walter Payne and allso I the saied John Payne Testator do witnesse the same with my signe and seale.
